| Description: | Característica esencial del Estado democrático es el control de la constitucionalidad y el órgano que cumple esta fundamental tarea, generalmente ocupa la más alta posición entre las instituciones públicas. Sólo puede haber constitucionalismo, cuando está asignado este control del que depende la vigencia máxima de la Constitución, la efectividad de las garantías de los derechos de las personas, el principio de la separación de Funciones del Estado y el de que dichos órganos deben actuar con arreglo a las leyes. |
