Abstract: | The main objective of this research work was based on analyzing whether there was a violation of the labor rights of public servants with physical disabilities during the COVID-19 pandemic in the public sector in the year 2019-2020. Job security for public servants is a fundamental right, and the pandemic has affected many workers with physical disabilities. The Constitutional Court of Ecuador has established a mandatory urisprudential rule for people with physical disabilities, who enjoy a principle of reinforced job stability, which means they cannot be fired due to their health condition. The methodology that was applied for this project was exploratory and field, which was based on the review of codes, books and articles on the rights of priority care people with disabilities. On the other hand, for field work, surveys and interviews were carried out, choosing a sample of public servants who work in the public institution of Manabí to obtain necessary information. It is concluded that job stability for people with physical disabilities is a fundamental right, and that the public sector must guarantee that these rights are respected during the COVID-19 pandemic. In addition, the response was that during the covid-19 pandemic very few public servants were affected. |
