Análisis jurídico – comparativo sobre la adopción homoparental en España, México y Ecuador.

Abstract

This research project proposes to compare the legalization and processing of homoparental adoption in countries such as Spain, Mexico and Ecuador. The content is aimed at identifying whether this type of adoption is reliable to promote human rights in Ecuador, with the best interest of the child prevailing, in order to compare it in countries such as Spain, Mexico and Ecuador. For the development of this research, parameters such as the historical and conceptual origin of homoparental adoption were studied; at the same time comparing the requirements and modes of adoption in same-sex couples that can serve as a legal basis for a future Ecuadorian national application; which allows generating a legal reform to carry out a model of a Bill, framed in a framework of validation policies. In order to achieve the objectives, a methodology was developed based on surveys with a generational sample in different cantons of Ecuador, which reflected the vision of Ecuadorian society for a social reality such as the legalization of homoparental adoption in the country. Finally, this research work is aimed at providing elements that facilitate the conclusion that both homoparental adoption and general adoption employ similar requirements, without employing different processing methods, while demonstrating a level of positive acceptability in Ecuadorian society, allowing the promotion of a Bill based on the essentiality of the best interest of the child, non-discrimination and Human Rights.
