Incorporación de jueces especializados en materia constitucional en el ordenamiento jurídico ecuatoriano.

Abstract

The figure of the Guardian of the Constitution is associated with the protection of human rights, this implies a process of guarantees and legal security for the people involved in any conflict, a task that corresponds to the judges, to comply with these constitutional and legal requirements, it is essential that judges have complete training in constitutional matters. Hence, the general objective of the research is to determine the need for the incorporation of constitutional judges in the Ecuadorian legal system. The research is qualitative with a descriptive level; Three types of scientific methods are included: deductive-inductive, analytical, and propositional. The population is made up of doctrine, regulations and jurisprudence, such as: Constitution of the Republic of Ecuador (2008), Organic Law of Jurisdictional Guarantees and Constitutional Control (2009); (Sarmiento, Atiencia, & Flores, 2023), (Tecota & Vázquez, 2023); and rulings of the Constitutional Court. For the collection, organization and analysis of information, observation and content analysis are the applied techniques, and the instruments are the observation guide and storage sheets. It is concluded that there is a need to incorporate constitutional judges into the Ecuadorian legal system through the specialization of existing ones. Likewise, the proposal consists of a training program in constitutional justice (jurisdictional actions), especially aimed at constitutional judges, with the joint action of the Judiciary Council of the corresponding university, in this case ULEAM.
