Abstract

This research studies the relationship between copyright and access to culture in technological media, analyzing the historical evolution and international legal frameworks that influence this dynamic. The main objective is to evaluate the impact of technology on the creation, distribution, and access to cultural works, identifying the tensions between copyright protection and the public's right to access culture. To achieve this, a documentary methodology was used, reviewing laws, international treaties, relevant academic literature, and case law. The results reveal that current copyright policies can significantly limit access to culture, especially in a digital context. The research highlights the need to adjust legal frameworks to balance the rights of creators with public access to culture. The main conclusion is that it is crucial to find a balance that allows for copyright protection without obstructing access to culture, promoting sustainable and equitable cultural development. This study contributes to academic knowledge and provides a foundation for the development of more inclusive policies in the digital age, suggesting future research and policies that favor equitable access to cultural resources, ensuring that copyright protection does not become a barrier to cultural preservation and dissemination.
