Abstract: | The present research project is based on demonstrating the effectiveness of DNA evidence against anticipated testimony, this to corroborate the commission of a crime of rape, thereby determining the imputability of the accused and his criminal responsibility. Therefore, we sought to establish what DNA is about, as a molecule within the human body that is characterized by containing genetic data unique to each person, in contrast to the anticipated testimony which, although effective, can be coerced by a third party. This research was carried out with the analysis of different documents, case analysis, with the objective of demonstrating the effectiveness of DNA in the criminal procedure in the crime of rape, in addition to using documentary bibliographic, deductive and hermeneutic methods. With which it was established that DNA, being a scientific and technical test, is transcendental to prove that a subject committed a criminal act, when corroborated by scientific methods. |
Description: | El presenta proyecto de investigación se basa en demostrar la efectividad de las pruebas de ADN frente al testimonio anticipado, esto para corroborar el cometimiento de un delito de violación, con lo que se determine la imputabilidad de acusado y su responsabilidad penal. Por ende, se buscó establecer de qué trata el ADN, como una molécula dentro del cuerpo humano que está caracterizada por contener datos genéticos únicos de cada persona, a contraste el testimonio anticipado el mismo que, aunque goza de eficacia puede ser coaccionado por un tercero. |
