Abstract

This research analyzes the importance of arbitration and mediation as alternative dispute resolution methods in the Portoviejo canton during the year 2022. Given the saturation of the judicial system and the high costs associated with traditional processes, the study aims to evaluate the effectiveness of these alternatives. Barriers such as lack of awareness and trust in their implementation, as well as the need for a more robust legal framework, are identified. The study is structured into five chapters: the first addresses the problem statement and objectives; the second presents the theoretical framework on alternative methods; the third describes the methodology used, which combines qualitative and quantitative approaches; the fourth chapter presents the results obtained from interviews with key stakeholders; and the fifth offers conclusions and recommendations to promote the use of these methods. Findings indicate that, although arbitration and mediation are viable and effective options, their adoption is limited. It is suggested to implement training and awareness programs to improve knowledge and acceptance of these tools within the community.
