Mínima intervención penal y justicia restaurativa: el papel de la educación en los jóvenes en situación de riesgo.

Abstract

This project focuses on the evaluation of the principles of minimal criminal intervention and restorative justice in Ecuadorian public policy, specifically in their application to young people at risk in Manta. The Research seeks to analyze traditional punitive strategies with alternatives that prioritize rehabilitation and social reintegration. Rather than severely punishing young offenders, minimal penal intervention and restorative justice advocate for limited and proportionate interventions that minimize the negative impact on their lives and encourage their positive reintegration into society. The analysis of the impact of these policies includes the evaluation of educational programs, mediation mechanisms, and the training of professionals in restorative justice practices. The qualitative approach is appropriate for this study because it allows a complex and multidimensional topic to be explored in depth. The bibliographic, descriptive and analytical-systemic methods complement each other, providing a rich and detailed understanding of the phenomenon. The bibliographic method establishes the necessary theoretical framework; the descriptive method offers a detailed portrait of the current situation; and the analytical-systemic method allows an integrated and comprehensive interpretation of the data. This comprehensive approach seeks to offer a viable alternative to traditional punitive methods, promoting a more humane and effective public policy.
