Razonamientos jurídicos del delito de sicariato y sus consecuencias jurídicas – 2022.

Abstract

The phenomenon of sicariato in the province of Manabí and in Ecuador at large has emerged as one of the most alarming manifestations of criminal violence in recent years. This practice, characterized by contract killings, not only poses a threat to public security but also undermines trust in state institutions and negatively impacts the quality of life of the population. In this context, it is essential to adopt a comprehensive approach that addresses both the underlying causes of sicariato and its immediate manifestations through legal, institutional, and social measures. Sicariato in Manabí and other regions of Ecuador has been influenced by a series of interconnected factors, including the presence of well-structured criminal organizations, lack of economic opportunities for youth, corruption in state institutions, and the impunity surrounding these crimes. Additionally, the ease of access to illegal firearms and the existence of complicity networks have contributed to the rise of this violent practice. In response to this situation, the Ecuadorian legal framework has established specific provisions to combat sicariato, with severe penalties for those who commit this crime. However, the effectiveness of these laws depends largely on their proper implementation and the institutional capacity to enforce the law fairly and equitably. In addition to law enforcement, it is essential to address the underlying causes of sicariato, such as lack of economic opportunities and the presence of criminal organizations, through social and economic development programs and the promotion of civic and ethical values in society. This research will conduct a comprehensive analysis of the phenomenon of sicariato in the province of Manabí, with the aim of better understanding its causes, manifestations, and consequences. It will examine the legal provisions related to sicariato in Ecuador, as well as institutional and community responses to this phenomenon. Additionally, it will explore the underlying causes of sicariato and propose recommendations to address this problem effectively and sustainably, with the aim of contributing to the construction of a safer, fairer, and more peaceful society.
