Importancia de los derechos de la naturaleza frente a los objetivos de desarrollo sustentable. Análisis teórico práctico. Año 2022.

Abstract

The general objective of the research is to analyze the importance of the rights of nature and its relationship with the sustainable development objectives in Ecuador 2022. The study is approached under the approach of three methods: inductive-deductive, analytical, and critical social, with a qualitative design, and with a descriptive level in order to know the qualities of the object of study. The population is represented by the set of norms, doctrine and jurisprudence related to the rights of nature and the objectives of sustainable development (SDG), for this reason mention is made of the Constitution of the Republic of Ecuador, the Organic Code of the Environment, ECLAC Reports, UN Instruments, jurisprudential positions of the Constitutional Court of Ecuador, among others, for which it was necessary to apply content analysis as a research technique. The rights of Nature and the SDGs form core aspects of the legal system of Ecuador, which is why the proposal of this research is to establish a Student Center defending the rights of nature with temporary strategies for each SDG. In the judicial decisions raised (mona Estrellita and Río Monjas cases), nature is assumed as a determining factor of all ecosystems and not as another element in favor of people, with this the SDGs have solid bases for their reach in Ecuador.
