Abstract

The purpose of this study is to analyze, from a theoretical and practical approach, the factors that lead to non-compliance with child support and the lack of comprehensive protection of the constitutional rights of children and youth. The aim is to explain the specific circumstances of the parties involved, the nature of the case, the unprotected rights and the judicial decision, given that the pension cannot be paid due to factors such as reduced working hours, insufficient salary and the difficult economic situation faced by the obligors. To achieve the objectives of this research, a qualitative approach was chosen, focused on the description and analysis of cases related to the comprehensive protection of the constitutional rights of the family, food and of children and young people in vulnerable situations. In this context, it is concluded that, although the principle of the best interests of the child must be respected, the personal urgency of those involved does not always guarantee compliance with the payment of child support. Furthermore, it is highlighted that Ecuadorian regulations are in line with the provisions of the United Nations Convention on the Rights of the Child, adopted on December 20, which assures minors the right to all the guarantees necessary to protect themselves and their rights against acts or omissions that affect them.
