Resumen : The present investigation focuses on the phenomenon of untimely dismissal and its legal effects in the private sector in the city of Manta during the year 2022, it refers to the unilateral termination of the employment contract by the employer without the just cause legally established or without compliance of the procedures required by current labor legislation. The study focuses on the legal and economic implications for workers affected by untimely dismissals. Research reveals that untimely layoffs have significant consequences for both employees, who face loss of income and job stability, and employers, who may face legal and financial penalties. In addition, the main causes of untimely dismissal are identified and the effectiveness of existing protection measures for workers is evaluated. Qualitative and quantitative methods are used, including surveys and interviews with workers, employers and labor law experts. The results suggest the need to reinforce training on labor rights and improve reporting and conflict resolution mechanisms to prevent and mitigate the effects of untimely dismissal. This study contributes to a better understanding of the challenges and solutions related to untimely dismissal in the private sector of Manta, offering practical recommendations for the protection of workers' labor rights and employers' obligation.
Descripción : La presente investigación enfoca el fenómeno del despido intempestivo y sus efectos jurídicos en el sector privado en la ciudad de Manta durante el año 2022, se refiere a la terminación unilateral del contrato laboral por parte del empleador sin la justa causa legalmente establecida o sin el cumplimiento de los procedimientos requeridos por la legislación laboral vigente.
