dc.descriptionConsciente de la necesidad de abordar los desafíos actuales y futuros de la industria de la moda, esta tesis investiga la eficacia del marco legal en la protección de derechos de propiedad intelectual en una industria que crece a pasos agigantados dentro del mercado comercial nacional e internacional. Muchos de los problemas que enfrenta esta industria nacen del desconocimiento del diseñador sobre como respaldar sus obras, la limitada información y el casi inexistente apoyo del Estado limitan el avance de la moda local.es
dc.description.abstractAware of the need to address the current and future challenges of the fashion industry, this thesis investigates the effectiveness of the legal framework in the protection of intellectual property rights in an industry that is growing by leaps and bounds within the national and international commercial market. Many of the problems faced by this industry arise from the designer's lack of knowledge about how to support their works, the limited information and the almost non-existent support from the State limit the advancement of local fashion. The importance of implementing environmental sustainability mechanisms that allow the industry to grow through a healthy environment is evaluated. It is highlighted that the change towards effective protection of the industry must occur from the hands that sew a garment and not from the garment as such, which is why the transparency that the industry must have in order to safeguard the rights and interests of everyone who is behind a brand. Furthermore, the analysis of penitent laws and regulations examines the impact that the lack of legal specification has on large companies, on local designers in development and on the communities of our country, and emphasizes the importance of an industry more aware of its rights. , which generates a safer environment for the creator and consequently there are more commercial benefits that allow Ecuador to gain a better position within the textile sector.es
