Abstract

This research focuses on the study of the right to membership in the Ecuadorian Social Security Institute, which is the body in charge of providing social security. The Constitution of the Republic of Ecuador establishes this right as a responsibility of the State, being public and universal, where protection against contingencies will be through mandatory universal insurance. The IEES, a public entity with legal status, has a mission to provide social security to all members, guaranteeing the right to Good Living. Nowadays, it is a really important issue, which with its constant deficiencies has given way to the violation of this right, causing a lack of access to said legal security, which should be one of the obligations that the employer must grant to their workers what is due to them by law, and in this way guarantee access to insurance benefits, whether for illness, disability, among others. During the course of the research, it was shown how social security is a fundamental right, recognized in the legal system. In order to meet the stated objective, quantitative research was used, including methods such as: deductive, inductive, analytical, synthetic, bibliographic, hermeneutic and case study, through which results were obtained that allowed to identify the various situations that contribute to the right to membership in the IEES in the Ecuadorian legal field.
