Abstract

The investigation focused on the analysis of the calculation of the alimony that taxi drivers must pay in the Chone canton during the years 2022. The main objective was to determine if the calculation of alimony adjusted to the economic reality of taxi drivers, because there is no established formality in salary income for this sector. The starting point was the problem that the income of taxi drivers does not have a fixed income, or job stability that allows establishing alimony, which could generate difficulties in fulfilling family obligations and the well-being of children and adolescents. The investigation was justified by the need to guarantee a balance between the needs of the drivers and those of their families, seeking a fair and equitable mechanism for calculating alimony. The methodology used was descriptive, through which the legal regulations, the alimony table, the SRI resolution on the income of taxi drivers were analyzed, and a survey was carried out among taxi drivers in the Chone canton. The results obtained revealed a significant discrepancy between the income of taxi drivers and the alimony that should be set. It was concluded that it is necessary to adjust the scale of perception of alimony to the socioeconomic reality of taxi drivers, considering their real income and the cost of living. The creation of a specific alimony scale for taxi drivers was proposed, with income ranges and pension percentages that adjust to their economic reality, as well as a process of periodically updating the scale. The creation of a dialogue table was recommended between representatives of the taxi drivers' union, competent authorities and experts in family law to evaluate the possibility of adjusting the alimony table, as well as the implementation of information campaigns aimed at taxi drivers about their rights and obligations in relation to alimony.
